Affirmative Action Program of Central Michigan University for Disabled Veterans and Veterans of the Vietnam Era

In accordance with the Plan for Affirmative Action at Central Michigan University, and with the requirements of Section 402 of the Vietnam era Veterans Readjustment Assistance Act of 1974, as amended, and applicable regulations (41 CFR Part 60-250), this Affirmative Action Program of Central Michigan University for Disabled Veterans and Veterans of the Vietnam Era is set forth below.
I. Affirmation of Policy
Central Michigan University affirms its continued commitment to a policy of equal employment opportunity and the elimination of prohibited discrimination within the institution. In accordance with the Plan for Affirmative Action at Central Michigan University, the University recognizes that non-discrimination and equal opportunity are legally, socially, and morally necessary, and that the University must take affirmative action to insure that these concepts are realized. Affirmative action refers to the collective measures taken to eliminate discrimination and provide equal opportunity either voluntarily or in compliance with applicable laws and regulations.
Central Michigan University is committed to both implementing a systemic affirmative action plan and to providing and maintaining programs and activities in support of human and civil rights.
On August 9, 1972, the University Board of Trustees adopted the following resolution:
"Recitals:
- The University as a unique public institution has recognized its responsibilities to protect the constitutional and statutory civil rights of persons connected with the University.
- On February, 16, 1965 the Board of Trustees took action to guarantee equal protection of the laws at the University.
- The Board of Trustees has encouraged and continues to encourage protection of civil rights including equal employment opportunity and action to assure equal employment opportunity.
- The Board by this resolution reaffirms its commitments in those areas.
Be It Resolved, that it is the continued policy of Central Michigan University that there shall be no discrimination in housing on the basis of race, color, religion, sex, age or national origin. The University again affirms its commitment to take affirmative action to realize equality in employment opportunity. The President is directed to continue taking necessary action to fully realize these policies."
In accordance with the above directive, the President of Central Michigan University places into effect the Affirmative Action Program of Central Michigan University for Disabled Veterans and Veterans of the Vietnam Era.
II. Legislative Coverage
Central Michigan University is committed to equality of employment opportunity for all individuals. The University agrees to take positive steps to achieve the objectives and requirements of the Vietnam era Veterans Readjustments Assistance Act of 1974, as amended. Dr. Leonard Plachta, President of Central Michigan University, affirms the University's policy concerning equal employment opportunity and places this program into effect.
Regulatory Definitions:
- "Special Disabled Veterans"
The term "Special Disabled Veterans" means (A) a veteran who is entitled to compensation (or who but for receipt of military retired pay would be entitled to compensation) under laws administered by the secretary for a disability rated at 30% or more; or (B) rated at 10 or 20% in the case of a veteran who has been determined under section 3106 of this title to have serious employment handicap; or (C) a person who was discharged from active duty because of a service -connected disability.
- "Disabled Veteran"
The term "Disabled Veteran" means (A) a person who is entitled to disability compensation under laws administered by the Veterans Administration for a disability rated 30% or more; or (B) a person who was discharged or released from active duty because of a service-connected disability.
- "Eligible Veteran"
The term "Eligible Veteran" means a person who (A) served active duty for a period of more than 180 days and was discharged or released therefrom with other than a dishonorable discharge; (B) was discharged or released from active duty because of a service-connected disability; or (C) as a member of the reserve component under an order to active duty pursuant to Section 672 (a), (d), or (g), 673, or 673b of title 10, served on active duty during a period of war or in a campaign or expedition for which a campaign badge is authorized and was discharged or released from such duty with other than a dishonorable discharge.
- "Veteran of the Vietnam Era"
The term "Veteran of the Vietnam Era" means an eligible veteran any part whose active military, naval, or air service was during the Vietnam era.
III. Equal Employment Practices and Procedures
The following actions set forth the University's practices and procedures which will serve to develop a continuing and self-sustaining University Affirmative Action Program.
- Monitoring, Evaluating, and Reporting
- The Office of Faculty Personnel Services, Staff Personnel Services and the Affirmative Action Office will periodically review all of the employment opportunities of disabled veterans and veterans of the Vietnam era. The following items will be included in this review:
- All recruitment procedures,
- The entire selection process,
- Promotions, transfers, reclassifications, subsequent appointments, tenure, and training,
- Wage and salary structure,
- Disciplinary action,
- Benefits, and
- Joint apprenticeship programs.
- The Office of Faculty Personnel Services, Staff Personnel Services and the Affirmative Action Office will review personnel processes to insure that present procedures afford appropriate consideration of the job qualifications of disabled veteran and Vietnam era veteran applicants and employees for job vacancies filled either by hiring or by promotion and for all training opportunities.
- The Office of Faculty Personnel Services, Staff Personnel Services and the Affirmative Action Office will review physical and mental job qualification requirements for all jobs as they become vacant, to assure that such qualifications are required to perform the essential functions of the job.
- The Office of Faculty Personnel Services, Staff Personnel Services and the Affirmative Action Office shall prepare and submit the "Federal Contractor Veteran's Employment Report VETS-100" by March 31 of each year.
- Dissemination of Policy
- Internal Dissemination:
- Annually, the President of Central Michigan University will reaffirm the University's commitment to provide equal employment opportunities to qualified disabled veterans and veterans of the Vietnam era. This reaffirmation will be coordinated with the annual reaffirmation of the University's commitment to its entire affirmative action program.
- The Affirmative Action Office, Faculty Personnel Services, and Staff Personnel Services will schedule periodic meetings to communicate the University's legal and equal employment commitments to all responsible employees.
- The above offices will continue to develop training programs, materials and workshops aimed at providing guidance to individuals about their affirmative action responsibilities. Such training should, also, be geared to raising awareness about individual and group needs, and, appropriate actions to meet these needs.
- The above offices will continue to be available to provide specialized services, assistance, and counseling aimed at helping units arrive at the University's affirmative action and equal opportunity objectives.
- Officials of each collective bargaining unit shall be regularly advised of the University's policy concerning disabled veterans and veterans of the Vietnam era and their cooperation shall be requested.
- Employees shall be notified of the existence of Central Michigan University's Affirmative Action Program for Disabled Veterans of the Vietnam Era through notices placed on appropriate employment bulletin boards across the University campus, as well as through information shared via appropriate memoranda. These notices will also indicate at what locations on campus this plan is available for inspection.
- External Dissemination:
- Appropriate recruiting sources, including state employment security agencies, shall be informed of Central Michigan University's policy concerning employment of disabled veterans and veterans of the Vietnam era, and shall be advised to actively recruit and refer qualified individuals for vacancies to the University.
- Written notification will be sent to subcontractors, vendors, and suppliers requesting appropriate action on their part.
- Qualified disabled veterans and veterans of the Vietnam era not currently in the workforce having requisite skills will be recruited through identifiable affirmative action measures.
- Outreach and Positive Recruiting:
Central Michigan University shall review its employment practices to insure that personnel programs provide the required affirmative action for employment and advancement of qualified disabled veterans and veterans of the Vietnam era. In conjunction with these programs, Central Michigan University shall undertake appropriate outreach and positive recruiting activities such as those listed below:
- A listing of job vacancies at Central Michigan University shall be sent to locations that are likely to notify qualified disabled veterans and veterans of the Vietnam era of employment opportunities. This action will include contacting the following state agencies:

- Annually, the Office of Staff Personnel Services shall contact appropriate veterans service organizations to seek advice technical assistance and referral of potential employees.
- Central Michigan University shall invite all disabled veterans and veterans of the Vietnam era to voluntarily identify themselves. Applicants and employees will be informed that such information will be kept confidential and that refusal to provide such information will not subject the applicant or employee to any adverse treatment. If provided, this information would be used only in accordance with the appropriate laws and regulations. "Voluntary Self-Identification Form (PDF)" shall be available at the Affirmative Action Office, 428 Park Library, or the Personnel Office, Rowe 109 or Warriner 365. See appendix II, for a sample of the "Voluntary Self-Identification Form."
- Accommodation:
- Central Michigan University shall make reasonable accommodation to qualified disabled veterans employees. Employees seeking accommodations for a disability should notify their immediate supervisor. Applicants seeking an accommodation for a disability may contact the hiring authority, Staff Personnel Services, Faculty Personnel Services, or may note the requested accommodation on the "Voluntary Self-Identification Form." All request for accommodation of a disability will be reviewed on a case by case basis. The University will make every attempt to work with the individual to grant reasonable accommodations to qualified applicants and employees.
- An applicant or employee is considered to be "qualified" if he/she can perform the essential functions of the job with or without accommodation. Staff Personnel Services and Faculty Personnel Services will regularly review job duties and qualifications to assure that individuals with disabilities are not unduly limited from employment opportunities. If through this or through any other process a job or class of jobs appears to disproportionately screen out individuals with disabilities, Staff Personnel Services or Faculty Personnel Services in conjunction with the Affirmative Action Office will study the job to assure the qualifications for the position are related to the essential functions of the job or class of jobs in question.
